Welcome to Orbit, an AI-native full-stack development platform. Orbit is operated by Forion Systems ("Forion", "we", "us", or "our").
These Terms and Conditions ("Terms") govern your access to and use of the Orbit platform, website, applications, and services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.
1. Acceptance of Terms
By creating an account, accessing, or using Orbit, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you are using the Services on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.
2. Description of Service
Orbit is an AI-powered development platform that generates application code from natural-language prompts. It operates within a sandboxed browser environment and supports output targets including Vite React, Next.js, HTML/CSS/JS, and Expo React Native. The Services include context-aware design reasoning, backend scaffolding, and code generation.
3. Account Registration and Security
- Eligibility: You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Services.
- Account Creation: To access certain features of Orbit, you must register for an account. You agree to provide accurate, current, and complete information during the registration process.
- Account Responsibility: You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use and Restrictions
You agree to use Orbit only for lawful purposes. You shall not:
- Use Orbit to generate malicious code, malware, spyware, or any software intended to cause harm, exploit vulnerabilities, or breach security systems.
- Use the Services in any way that violates any applicable local, national, or international law or regulation.
- Attempt to reverse engineer, decompile, hack, disable, or disrupt the operation of Orbit or Forion's infrastructure.
- Resell, lease, or sub-license the Services without our express written consent.
- Use Orbit to generate content that is defamatory, obscene, fraudulent, or infringes on the intellectual property rights of others.
5. Intellectual Property Rights
5.1 Your Content and Generated Code
You retain all ownership rights to the prompts, input data, and materials you submit to Orbit ("User Content"). Subject to these Terms and your compliance with them, you also own the copyright to the application code, designs, and software outputs generated by Orbit based on your User Content ("Generated Code").
5.2 Forion's Intellectual Property
Forion Systems retains all rights, title, and interest in and to Orbit, the underlying AI models, algorithms, UI/UX designs, platform infrastructure, and any software used to provide the Services. Nothing in these Terms gives you a right to use the Forion name, Orbit name, trademarks, logos, or domain names without our prior written consent.
6. Accuracy of AI-Generated Content (Important)
AI can make mistakes, so please double-check all data, code, and output on your own. Orbit uses advanced Large Language Models (LLMs) and artificial intelligence to generate code and application infrastructure. Because AI is probabilistic, the Generated Code may contain errors, logical flaws, security vulnerabilities, or hallucinations. You acknowledge that:
- You are solely responsible for reviewing, auditing, and testing the Generated Code before deploying it into any production environment.
- You must independently verify any data, logic, or claims generated by the AI.
- Forion Systems is not liable for any damages, security breaches, or losses resulting from flawed or incorrect AI-generated output.
7. Subscriptions, Billing, and Payments
- Fees: Certain features of Orbit may be subject to subscription fees or usage-based pricing. All fees are stated in US Dollars and are non-refundable except as required by law.
- Billing: By providing a payment method, you authorize Forion to charge the applicable fees on a recurring basis as outlined in your chosen plan.
- Changes to Pricing: We reserve the right to modify our pricing at any time. We will provide reasonable notice of any price changes before they apply to your next billing cycle.
8. Data Privacy
Your privacy is important to us. Our collection, use, and handling of your personal information and project data are described in our Privacy Policy. By using Orbit, you consent to the data practices described in that policy.
9. Disclaimer of Warranties
ORBIT IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. While we strive to ensure that Orbit generates high-quality, production-grade code, Forion makes no warranties, express or implied, regarding the accuracy, security, or fitness for a particular purpose of the Generated Code or the platform itself.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FORION SYSTEMS, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) ORBIT;
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES;
- ANY ERRORS, BUGS, OR VULNERABILITIES IN THE GENERATED CODE;
- UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
11. Indemnification
You agree to defend, indemnify, and hold harmless Forion Systems and its employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to Orbit, or any applications built using Generated Code from Orbit.
12. Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
13. Modifications to the Service and Terms
We reserve the right to modify or discontinue, temporarily or permanently, the Orbit service (or any part thereof) with or without notice. We also reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of Orbit after such changes constitutes your acceptance of the new Terms.
